TERMS OF SERVICE

Acceptance of Terms
These Terms of Service ("Terms") govern your use of gateway.esca.org (the "Site") and The Gateway compliance management program (the "Program"), operated by the Exhibition Services & Contractors Association ("ESCA," "we," "us," or "our"). By accessing the Site or submitting information through it, you agree to be bound by these Terms. If you do not agree, do not use the Site.

Description of the Program
The Gateway is an industry compliance management program that facilitates the submission, review, and verification of insurance certificates and related documentation from Exhibitor Appointed Contractors, vendors, and other participants at partnering events. Insurance certificate review is performed by ExhibitorInsurance.com, operated by Neostein Risk Management Inc. ("Service Administrator"), acting as ESCA's compliance verification partner.

Eligibility
You must be at least 18 years of age and authorized to act on behalf of the business or entity on whose behalf you are submitting information. By using the Site, you represent and warrant that you meet these requirements.

User Submissions
You agree to provide accurate, current, and complete information when submitting certificates of insurance and related materials. You are solely responsible for the accuracy and validity of any information or documentation submitted. ESCA and the Service Administrator may reject, return, or request correction of any submission that is inaccurate, incomplete, or does not meet the stated requirements of the applicable event.

Fees and Payment
A submission fee applies to certain uses of the Site, as disclosed at the time of submission. Fees are collected by the Service Administrator on behalf of the Program. All fees are non-refundable except as expressly stated at the point of payment or as required by applicable law. Resubmissions related to the same event are included within the original fee and do not incur an additional charge.

Review and Clearance
Review of submitted certificates is performed against the insurance requirements established by the applicable event organizer or Official Service Provider. Clearance indicates that the submitted documentation meets the stated requirements as of the date of review. Clearance does not constitute legal, insurance, or professional advice, and does not guarantee acceptance at the event, access to the venue, or coverage under any policy.

No Insurance or Legal Advice
ESCA is not an insurance broker, agent, underwriter, or legal advisor. The Site and the Program do not provide insurance, legal, or professional advice. Users are responsible for procuring their own insurance coverage and consulting qualified professionals regarding their coverage obligations.

Links to Third-Party Sites
The Site may contain links to third-party websites, including ExhibitorInsurance.com. ESCA does not operate these sites and is not responsible for their content, terms, or privacy practices. Your use of any linked site is at your own risk and subject to that site's terms.

Intellectual Property
All content on the Site, including logos, text, graphics, and the name "The Gateway, powered by ESCA," is owned by or licensed to ESCA and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any Site content without prior written permission from ESCA.

Prohibited Conduct
You agree not to: (a) submit false, fraudulent, or misleading information; (b) attempt to interfere with or disrupt the operation of the Site; (c) access the Site by any means other than the interface provided; (d) use the Site for any unlawful purpose; or (e) upload any material that infringes any third party's rights.

Disclaimer of Warranties
The Site and the Program are provided on an "as is" and "as available" basis. ESCA disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. ESCA does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

Limitation of Liability
To the maximum extent permitted by law, ESCA, its officers, directors, employees, members, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site or the Program. ESCA's aggregate liability for any claim related to the Site or the Program shall not exceed the fees paid by you, if any, for the specific submission giving rise to the claim.

Indemnification
You agree to indemnify, defend, and hold harmless ESCA, the Service Administrator, and their respective officers, directors, employees, and agents from any claim, damage, loss, or expense (including reasonable attorneys' fees) arising out of your use of the Site, your submissions, or your violation of these Terms.

Modifications
ESCA may modify these Terms at any time. The updated Terms will be posted on the Site with a revised "Last updated" date. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Cook County, Illinois.
